ORDER ADOPTING MAGISTRATE JUDGE'S REPORT AND RECOMMENDATION

RAAG SINGHAL, UNITED STATES DISTRICT JUDGE.

THIS MATTER has come before the Court on Plaintiff's Motion for Summary Judgment (DE [13]) and Defendant's Motion for Summary Judgment (DE [14]), which were referred to Magistrate Judge Alicia O. Valle for Report and Recommendation (DE [5]). Judge Valle issued a Report and Recommendation to District Judge on August 18, 2022 (DE [26]). The Court has reviewed the entire file and record and has made a de novo review of the issues. No objections to the magistrate judge's Report and Recommendation having been filed, it is hereby

ORDERED AND ADJUDGED as follows:

1. The magistrate judge's Report and Recommendation (DE [26]) is AFFIRMED and ADOPTED.

2. Plaintiff's Motion for Summary Judgment (DE [13]) is DENIED.

3. Defendant's Motion for Summary Judgment (DE [14]) is GRANTED.

4. The Administrative Law Judge's Decision is AFFIRMED.

5. The Clerk of Court is directed to CLOSE this case. Any other pending motions are DENIED AS MOOT.
