Motion by the respondent to dismiss an appeal from a judgment of the Supreme Court, Orange County, dated January 26, 2012, as untimely taken, and to waive the motion filing fee.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion which is to waive the motion filing fee is granted; and it is further,

ORDERED that the branch of the motion which is to dismiss the appeal is denied.
