FINAL ORDER BACKGROUND
This Court entered its Memorandum Decision and Final Order July 1, 2003 (Dkt. No. 164) and Judgment (Dkt. No. 165).
Subsequently, the Guardian Ad Litem filed under seal Guardian Ad Litem's Report Regarding Trust Agreement, on September 3, 2003 (Dkt. No. 166).
Based upon the Guardian Ad Litem's report, the Veenstra Educational Trust ("Educational Trust"), as proposed by the Guardian Ad Litem, was amended from the version filed with the previous Guardian Ad Litem's report and referred to in this Court's Memorandum Decision and Final Order (Dkt. No. 164). The Trust Agreement attached to the Guardian Ad Litem's report regarding Trust Agreement (Dkt. No. 166) has been considered by the Court and found to be in the best interests of the children for the reasons set forth in said report, and based upon this Court's knowledge of the circumstances of this matter.
Therefore, it is ordered that the Trust Agreement, attached to Dkt. No. 166, shall be executed pursuant to this Court's previous Memorandum Decision and Final Order (Dkt. 164).
The Trust Agreement shall remain under seal (to protect the minors' identities) and this Court shall retain jurisdiction to implement or adjudicate any controversy regarding management of the Trust and the terms and agreements embodied in and memorialized by the Memorandum Decision and Final Order (Dkt. No. 164).
It is further ordered and this Court finds good cause to order, that the duly appointed Trustee can make a direct payment in the amount of $1,500.00 to Dr. Mariano Herrera Rivera for the purpose of the surgery as requested for one of the minor children. The Trustee shall have full authority, by the powers vested in the Trust Agreement, to make appropriate payments for services as determined by the Trustee.
