The Court has before it a Report and Recommendation filed by the United States Magistrate Judge. (Docket No. 75.) Neither the plaintiff nor the defendants have filed objections to the Report and Recommendation.

The Court has reviewed the Report and Recommendation, has found the conclusions therein to be well reasoned and supported by relevant legal precedent, and will therefore adopt the Report and Recommendation as its own. Accordingly,

NOW THEREFORE IT IS HEREBY ORDERED that the Report and Recommendation (Docket No. 75) shall be, and the same is hereby, ADOPTED as the decision of the District Court.

IT IS FURTHER ORDERED that the Motion to Dismiss Defendant Gene Schiffler (Docket No. 53) is GRANTED.

IT IS FURTHER ORDERED that the Motion to Dismiss for Failure to Prosecute in the Name of the Real Party in Interest (Docket No. 58) is DENIED.
