Vassilatos v. Vassilatos

Supreme Court, Appellate Term, First Department
Nov 12, 1959
21 Misc. 2d 261 (N.Y. App. Term 1959)

Opinion

November 12, 1959

Appeal from the Municipal Court of the City of New York, Borough of Manhattan, NATHANIEL SORKIN, J.

Daniel J. Pinsky for appellant.

George M. Aronwald for respondents.

The record does not warrant the court's finding that $500 was a fair and reasonable charge for the legal services plaintiff Aronwald rendered in behalf of plaintiff wife, both in the Magistrate's Court and the Domestic Relations Court.

The order appealed from should be modified to the extent of directing an assessment of plaintiffs' damages, and the judgment vacated, all without costs.

Concur — HOFSTADTER, J.P., AURELIO and TILZER, JJ.

Order modified, etc.
