Vargas v. Parole Board

Supreme Court of Michigan
Dec 22, 1998
459 Mich. 919 (Mich. 1998)

Opinion

No. 109590.

December 22, 1998.

Summary Dispositions December 22, 1998.

On August 19, 1998, the successor judge reviewed the record and found "no reason to object to a public hearing. . . ." See 457 Mich. 886 (1998). In lieu of granting leave to appeal, the circuit court's order of affirmance is vacated, and the case is remanded to the Parole Board for another parole release interview. The 1993 written objection of the Saginaw Circuit Judge to parole release is to be stricken from the petitioner's file and it is to be replaced with the August 19, 1998, opinion of the successor judge, who does not object to the Parole Board proceeding with a public hearing. MCR 7.302(F)(1). Jurisdiction is not retained. Court of Appeals No. 196404.
