ORDER

On December 13, 2022, the magistrate judge filed findings and recommendations (ECF No. 3), which were served on plaintiff and which contained notice that any objections to the findings and recommendations were to be filed within fourteen days. On December 27, 2022 and on January 13, 2023, plaintiff filed responses to the findings and recommendations (ECF Nos. 4, 5), which the court construed as requests to extend the time to file an objection. See Prior Order, ECF No. 6. The court granted the requests and directed plaintiff to file any objections to the findings and recommendations by February 24, 2023. Id. The court has not received plaintiff's objections.

In accordance with the provisions of 28 U.S.C. § 636(b)(1)(C) and Local Rule 304, this court has conducted a de novo review of this case. Having reviewed the file, the court finds the findings and recommendations to be supported by the record and by the proper analysis.

Accordingly, IT IS ORDERED:

1. The Findings and Recommendations filed December 13, 2022 (ECF No. 3) are ADOPTED;

2. The action is be DISMISSED WITH PREJUDICE; and

3. The Clerk of Court is directed to CLOSE this case.
