TIMOTHY KAYLON VALDEZ, Appellant v. THE STATE OF TEXAS, Appellee

On Appeal from the 291st Judicial District Court Dallas County, Texas Trial Court Cause No. F21-75126-U

ORDER

DENNISE GARCIA JUSTICE

Before the Court is appellant's motion for extension of time to file the brief. Appellant's appointed counsel seeks a sixty-day extension from the previous due date, June 15, 2023, and requests that the time to file the brief be extended to August 14, 2023. (Appellant's motion states the requested extension is through August 13, 2023; however, August 13, 2023, is a Sunday, so the time to file would be extended to August 14, 2023. See Tex. R. App. P. 4.1(a).). Appellant's motion is GRANTED, and we ORDER the brief filed on or before August 14, 2023. Due to the extraordinary length of this extension, counsel is cautioned that if appellant's brief is not filed by August 14, 2023, this appeal may be abated for the trial court to make findings in accordance with rule of appellate procedure 38.8 and whether counsel should be removed from representing appellant and new counsel appointed. See Tex. R. App. P. 38.8(b)(2).
