Dear Mr. Waterhouse and Counsel:

USAA's declaratory action against Kenneth Hollingsworth, M.D., Stacy L. Hollingsworth (now LaMotta), and Mark D. Waterhouse is currently pending before the Court. Due to the Court's decision to dismiss the underlying action, Waterhouse v. Hollingsworth, C.A. No. 06C-07-031, by way of Court order dated May 3, 2010, the present case is rendered moot and is therefore DISMISSED.
