ORDER


The Motion of Gregory M. Simonsen, Jason K. Nelsen and the law firm of Rinehart Simonsen Fetzer to Withdraw as Counsel for the Defendants in the above captioned case came on for Hearing on May 6, 2004. Present at the Hearing was Gregory M. Simonsen of the law firm of Rinehart Simonsen Fetzer, John Holt and Don Winder as counsel for Plaintiffs and Blake Ostler. The Court considered the Motion to Withdraw and found that it was well taken and should be granted.

WHEREFORE it is ordered that the Motion of Gregory M. Simonsen, Jason K. Nelsen and the law firm of Rinehart Simonsen Fetzer to Withdraw as Counsel for Defendants is granted. Accordingly, leave of Court is given for Mr. Simonsen and the members of his law firm to withdraw as counsel for Defendants Kinnon Sandlin, Ted Heap, Grant Taylor, Apex Holdings, LLC, MRG Investment Group, LLC, and Summit Airport Hotel, LLC.
