CASE NUMBER CR-2-97-128 (S.D. Ohio Aug. 25, 2009)

Opinion

CASE NUMBER CR-2-97-128.

August 25, 2009

ORDER

This matter is before the Court for consideration of Defendant's pro se Motion for Termination of his Supervised Release or Reduction of the Supervised Release. Defendant asserts that the imposition of a five-year term of supervised release imposes an undue hardship and constitutes an abuse of judicial discretion.

On June 17, 1999, the Court imposed a term of 148 months of imprisonment. On February 29, 2008, the Court granted a motion to reduce Defendant's sentence pursuant to 18 U.S.C. § 3582(c)(2) and reduced Defendant's term of imprisonment to 121 months. As a result of the reduction in his sentence, Defendant was released from the custody of the Bureau of Prisons and began supervised release in March 2008. He filed the instant Motion July 11, 2008.

The Court has reviewed Defendant's request for early termination of his supervised release, and finds no basis to alter the term of his original sentence. The Court concludes that a five year term of supervised release remains appropriate. Defendant's Motion to terminate or reduce the term of his supervised release (Doc. #207) is hereby DENIED.

IT IS SO ORDERED.
