Opinion
Case No. CR2-09-235.
November 24, 2009
ORDER
This matter is before the Court on the Unopposed Motion of the United States to Edit Surplusage from Copies of Government Exhibits in Trial Notebooks (Doc. 11). On October 29, 2009, this Court entered a scheduling order in this case. That order incorporated by reference certain procedures to be followed at trial. Pursuant to that Order, the Government is in the process of compiling exhibits for use at trial. Some of these exhibits include forms seized in February 2009, when Government agents executed a search warrant at Waldren's Hunting Supplies in Newark, Ohio. The Government anticipates using hundreds of Alcohol, Tobacco, Firearms, and Explosives ("ATF") Forms F 4773 at trial. These forms vary in length. In addition to pages identifying a firearms transaction and bearing signatures, the forms also include other information that is not relevant to this case, such as how to complete the form. The Court hereby allows the Government to include in its trial exhibit notebooks only pertinent pages of each of its ATF Forms F 4773 exhibits. These pages shall include one page identifying the firearms transaction and another page bearing signatures.
IT IS SO ORDERED.
