ORDER OVERRULING OBJECTIONS, ADOPTING REPORT AND RECOMMENDATION TO DENY ADDITIONAL CLAIM and DENYING MOTION TO VACATE, SET ASIDE OR CORRECT SENTENCE


Came this day for consideration the additional claim on defendant ZOSIMO REYES SAENZ's motion to vacate, set aside or correct sentence by a person in federal custody which was remanded to this Court by the Fifth Circuit Court of Appeals. On December 3, 2002, the United States Magistrate Judge issued a Report and Recommendation to Deny Additional Claim in this cause, recommending therein that defendant's additional claim be denied. On December 24, 2002, defendant, acting pro se, filed objections to the Report and Recommendation.

The United States District Judge has made an independent examination of the record in this case. Defendant's objections to the Report and Recommendation are hereby OVERRULED, and the Magistrate Judge's Report and Recommendation is hereby ADOPTED. Accordingly, defendant's motion to vacate, set aside or correct sentence is, in all things, DENIED.

IT IS SO ORDERED.
