Case No. 3:06-CR-129 (S.D. Ohio Sep. 25, 2009)

Opinion

Case No. 3:06-CR-129.

September 25, 2009

ENTRY AND ORDER

This matter came before the Court for an in chambers conference on September 23, 2009 at 10:00 AM.

The purpose of said conference was to determine how the Court would proceed with regard to the last remaining claim to the property located at 3776 Indian Ripple Road, which was asserted by Amanda Aldridge, 657 McBee Road, Bellbrook, OH.

Ms. Aldridge asserted this claim in response to the Government's Preliminary Order for Forfeiture. Ms. Aldridge, however, has not prosecuted this claim further. The Court in setting said conference noticed Ms. Aldridge that attendance by her was mandatory and failure to appear could result in sanctions including the dismissal of her claim for lack of prosecution. Ms. Aldridge did not appear and the Government moved the Court on the record to dismiss Ms. Aldridge's claim.

The Court will give Amanda Aldridge through October 26, 2009 to respond to said Motion to Dismiss her claim and/or show cause why her claim should not be dismissed for failure to appear as required by the Court and/or prosecute her claim.

IT IS SO ORDERED.
