ORDER


On November 23, 2010, the Court sentenced Defendant to a period of incarceration for nine months minus time served to date-which the Court understood to be seven months in federal custody-followed by three years of supervised release, with six months of supervised release to be served at the Alvis House. Thereafter, Defendant's counsel informed the Court that the time Defendant has served to date has been primarily in state custody rather than federal custody. On November 30, 2010, the Court held a telephonic conference on the matter.

For the reasons set forth on the record at that conference, and pursuant to Federal Rule of Criminal Procedure 35(a), the Court hereby corrects the technical error in sentencing. Defendant is sentenced to two months of incarceration from November 23, 2010, followed by three years of supervised release that includes six months at the Alvis House. All other terms and conditions of the sentence imposed upon Defendant at the sentencing hearing held on November 23, 2010 shall remain in effect. The Judgment and Commitment Order shall be entered separately.
