ORDER


This matter is before the Court on the United States of America's Motion to Participate in the Sentencing of Ayers and Faulkenberry by Telephone (Dkt. 1073). The United States of America requests that Kathleen McGovern, Deputy Chief, Criminal Division, Fraud Section, in Washington. D.C., be permitted to appear at the resentencings of Defendants Ayers and Faulkenberry on Friday, October 22, 2010 by telephone. The United States of America was aware that the resentencings were scheduled for October 22, 2010 on October 13, 2010, yet the Court only received this request on October 21, 2010. Assistant U.S. Attorney Doug Squires will appear in-person and argue the positions of the government. Accordingly, this Motion is DENIED.

IT IS SO ORDERED.
