ORDER APPOINTING JAMES M. BRANDEN AS COUNSEL TO DEFENDANT UNDER THE CJA


WHEREAS, the defendant Otis Parkes appealed from a judgment of conviction entered by this Court;

WHEREAS, the Second Circuit Court of Appeals assigned James M. Branden, Esq., under the Criminal Justice Act, to represent Mr. Parkes on the appeal;

WHEREAS, pursuant to Mr. Parkes' motion, the Second Circuit Court of Appeals held the appeal in abeyance and remanded the matter to this Court for the filing of a motion for a new trial pursuant to Rule 33 of the Federal Rules of Criminal Procedure;

WHEREAS, at a conference before this Court held on October 20, 2005, Mr. Branden moved, without objection from the government, to be continued as counsel to Mr. Parkes before the District Court, and, after consideration, the Court granted that motion;

IT IS NOW ORDERED that James M. Branden, Esq., is continued as counsel to Mr. Parkes before the District Court pursuant to the Criminal Justice Act (nunc pro tunc 10/20/05).
