DEFICIENCY ASSESSMENT ORDER


This case is before the Court on Defendant's Notice of Appeal (Doc. No. 977 in 3:98-cv-410).

Defendant filed the Notice of Appeal without paying the appellate filing fee of $255 as required by law. When entering final judgment in the case, Judge Rice determined that the Defendant would not be permitted to proceed on appeal in forma pauperis. Accordingly, the filing fee of $255.00 is hereby assessed against Defendant who is ordered to pay the same to the Clerk of this Court not later than March 13, 2006. Failure to pay will result in notice to the Court of Appeals which may then dismiss the case for non-payment of the fee.
