ORDER


The defendant has moved orally for a continuance of the trial, which is currently scheduled on April 26, 2006. The court held an evidentiary hearing on defendant's motion to suppress evidence on April 24, 2006, and will issue a decision shortly on that motion. In the event that the motion is denied, defense counsel requests additional time to discuss the ramifications of the decision with the defendant and to decide whether to proceed to trial.

The court finds pursuant to 18 U.S.C. § 3161(h))(8) that a continuance is warranted in the interests of justice, and that the need for a continuance outweighs the best interests of the defendant and the public in a speedy trial. Counsel requires additional time to confer with defendant and to prepare for trial despite the exercise of due diligence. The motion is granted, and the trial is continued to May 8, 2006, at 9:00 a.m.
