ORDER


The Court has reviewed in camera the Motion By The Office Of The Inspector General Of The Department Of Justice Pursuant To Local Rules 57.1 (E) (G) For Leave To Publicly Release Redacted, Unclassified Version Of Its Report Entitled "A Review Of The FBI's Handling Of Intelligence Information Related To The September 11 Attacks" ("Motion To Release") (Docket #1301) and the attached redacted, unclassified version of the Report, which incorporates all of the substantive redactions that were requested by defense counsel and were of concern to the Court. Given that neither the prosecutors nor defense counsel have filed any objection to the redacted, unclassified version of the Report being made public and finding that the redactions adequately protect the defendant's right to a fair trial, the Motion To Release is GRANTED; and it is hereby

ORDERED that the Inspector General of the Department of Justice may publicly release the redacted, unclassified version of its Report entitled "A Review Of The FBI's Handling Of Intelligence Information Related To The September 11 Attacks," which is attached to its Motion To Release as Exhibit B.

This ruling renders moot the Government's Motion To Seal Pursuant to Local Criminal Rule 49 (E) ("Motion To Seal") (Docket #1299), which is DENIED, except as to Exhibit A to the Inspector General's Motion To Release. Because Exhibit A identifies the specific materials redacted from Exhibit B, Exhibit A must remain under seal. Accordingly, it is hereby.

ORDERED that with the exception of Exhibit A, the entirety of the Inspector General's Motion To Release (Docket #1301), the Government's Notice Of Filing Of Government's Motion To Seal Pursuant To Local Criminal Rule 49(E) (Docket #1298), the Government's Motion To Seal (Docket #1299), and the Government's Non-Confidential Memorandum Accompanying Its Motion For A Protective Order Providing Prospectively For Filing Documents Under Seal Pursuant To Local Rule 49(E) (Docket #1300) are to be filed publicly in the case file.

The Clerk is directed to forward copies of this Order to counsel of record and the Court Security Officer.
