United States District Court, S.D. New York

No. 04 Cr. 503 (TPG) (S.D.N.Y. Feb. 23, 2005)

Opinion

No. 04 Cr. 503 (TPG).

February 23, 2005

MEMORANDUM

The Court has received a letter dated February 16, 2005 from Irving Anolik, Esq. Mr. Anolik states that he has been consulted by defendant, although he does not actually say that he has been retained nor is there any motion to substitute Mr. Anolik for the attorney of record, Michael Mendelson, Esq.

However, Mr. Anolik requests that the sentence date be adjourned from March 15 to April 18. The stated reason for this request is so that a motion to set aside the verdict can be made.

The request to adjourn the sentence is denied. As far as a possible motion to set aside the verdict, the Court can make no ruling, since no actual motion is made and there is no reference to any statute or rule which might be the basis for such a motion.

SO ORDERED.
