ORDER


Defendant filed an ex parte application on February 6, 2006 for the issuance and service of a subpoena at government expense pursuant to Fed.R.Crim.P. 17(b). The Court finds that Defendant is indigent and that the witness sought by Defendant is necessary to his defense. Accordingly, Defendant's application is granted. The United States Marshal is ordered to tender a one-day witness fee and mileage fee to the witness. The subpoena will be served by the office of the Federal Public Defender.
