OPINION


This case was remanded to this Court for further proceedings in conformity with United States v. Crosby, 397 F.3d 103 (2d. Cir. 2005). In Crosby, the Second Circuit ordered a remand in order to allow the District Court to determine whether to resentence in light of Booker/Fanfan. On August 9, 2005, the Court invited counsel to submit their views on resentencing in writing. That briefing was concluded in August of this year.

Having considered the views of counsel, the Court has decided to resentence the defendant.
