FINAL ORDER OF FORFEITURE
WHEREAS, on July 12, 2005, this Court entered an Amended Preliminary Order of Forfeiture, ordering defendant to forfeit the following property (hereinafter referred to as the "subject property):
CASH PROCEEDS
a. $55,090.00 in United States Currency seized from the residence of Joseph Henderson on December 15, 2004.ASSORTED WEAPONS
a. Taurus 9mm semi-automatic handgun, serial #TVK03912
b. Loaded North American Arms Five Shot Revolver, serial #LO52235
c. Loaded Taurus .45 Caliber Handgun, serial #NUI90579ASSORTED JEWELRY
a. One 10K YG Herringbone neck chain (15mm wide and 20" long)
b. One 14K YG Cross set with 57 RBC diamonds. The attached chain is set with 6 diamonds.
c. One 10K YG Hoop earrings set with 52 round diamonds in each. The diamonds are set in a double row down the front of the earring. The earrings are pierced with
a hinged post closure.
d. One ladies 14K YG mounting set with one marquise shaped diamond in the center and 48 baguette diamond melee channel set in 4 channels, two on each side of the center diamond.
e. One ladies 14K YG wedding set. The engagement ring has a marquise shaped diamond in the center in a 6 prong head and 22RBC Diamond melee channel set in 4 channels, two on each side of the center diamond. The wedding ring is fitted style set with 6 RBC diamonds.
f. One 10K YG neckpiece set with 125 RBC diamond melee. The piece is on a 6mm wide Bismark chain with the centerpiece in a "V" shape. The "V" shaped piece set WG and set with all the diamonds.
g. One ladies 10K YG Tennis bracelet. The bracelet is 15mm wide and is 7.25" long and has 33 links. Each of the links is set with RBC diamonds. The bracelet has a total of 165 RBC diamonds.
h. One 10K YG fancy link neck chain. The links are pinched style and hollow with a lobster claw closure.
i. One 10K YG bracelet. The bracelet is a pinched style link chain with a lobster style closure.
j. One gents 14K YG mounting set with 5 RBC diamonds. The diamonds are set on an angle across the finger; and
WHEREAS, the United States caused to be published in The Daily Court Reporter, a newspaper of general circulation, notice of this forfeiture and of the intent of the United States to dispose of the property in accordance with the law and as specified in the Preliminary Order and a Notice of Publication was filed on March 3, 2006 (Doc. # 43);
WHEREAS, no timely claim has been filed; and
WHEREAS, the Court has found that the defendant has an interest in the property that is subject to forfeiture pursuant to 21 U.S.C. § 853 (a)(1) and (2);
NOW THEREFORE, IT IS HEREBY ORDERED, ADJUDGED AND DECREED that the Subject Property is hereby forfeited to the United States of America pursuant to 21 U.S.C. § 853 (a)(1) and (2); and
IT IS FURTHER ORDERED, ADJUDGED AND DECREED that all right, title and interest to the property described above is hereby condemned, forfeited and vested in the United States of America, and shall be disposed of according to law; and
IT IS FURTHER ORDERED that the United States District Court shall retain jurisdiction in the case for the purpose of enforcing this Order.
