Opinion

Case No. CR01-186-S-EJL

May 24, 2002

ORDER

Pending before the Court in the above-entitled matter is Defendant Shane Gulley's Motion to Vacate Sentencing Date (Docket No. 21). The Government has indicated in its response it does not oppose a continuance.

The Court acknowledges the Defendant's desire to get his affairs in order, however the Defendant entered his plea on April 1, 2002 and was given over two months to get his affairs in order. In the interests of justice, the Court will allow a continuance of approximately one month so that Defendant can research and respond to alleged inaccuracies in the pre-sentence report.

Being fully advised in the premises, the Court hereby orders that:

1) The sentencing hearing set for June 10, 2002 is VACATED AND RESET for July 8, 2002 at 10:30 a.n. in Boise, Idaho.
2) The parties shall have until Monday, June 17, 2002 to file any further specific and detailed objections to the pro-sentence report.

SO ORDERED.
