ORDER


Before the court is DefendantS' motion to continue the trial date. Crucial witnesses have been unavailable and at least one witness will not be available at the time trial is currently scheduled. The court finds the interests of Justice outweigh the interest of the defendants and the public in a speedy trial.

The trial date of April 30, 2002, shall be stricken. Trial will be held on May 28, 2002, beginning at 1:30 p.m. in Moscow, Idaho. The time from April 18, 2002, and May 28, 2002, shall be excluded from calculation of time for purposes of the Speedy Trial Act. 18 U.S.C. § 3161.

The pretrial conference scheduled on April 24, 2002 is also stricken. Counsel shall advise the court it a pretrial conference is required in advance of the new trial date.
