Memorandum Order
At 1:24 p.m. on Friday, August 12, 2005, the Court received a telephone message from the U.S. Marshal's Office regarding the Defendant. They expressed concern that he might not be able to make his court appearance on Monday because of the physical effects of his chemotherapy. Accordingly, this matter is adjourned. In the interest of justice, pursuant to 18 U.S.C. § 3161(h) (1) (A), the Court excludes time for 30 days from Monday August 15, 2005 for purposes of the Speedy Trial Act.
