ORDER DISMISSING ACTION


By order filed January 17, 2003, the court advised plaintiff that if it did not appear by counsel within 30 days of the date of said order, or show good cause by such date as to why it should be allowed additional time to appear by counsel, the above-entitled action would be dismissed without prejudice for failure to prosecute. See Fed.R.Civ.P. 41(b).

To date, plaintiff has neither appeared by counsel nor shown cause as to why additional time to so appear should be granted. Accordingly, the action is hereby DISMISSED without prejudice for failure to prosecute.

IT IS SO ORDERED.
