ORDER


On June 21, 2005, the Government and the defendant signed a Deferred Prosecution Agreement, which the Court has reviewed and approved. The Agreement refers to the filing of a two-count Information on December 14, 2004, which is in fact an accurate account of the commencement of this proceeding. Although the Government filed a superceding one-count Information on May 24, 2005, the failure of the Agreement to mention that filing does not affect in any respect the validity of the Agreement. Accordingly, the Clerk of the Court is directed to file the Agreement.
