ORDER


On June 3, 2002 the Court continued the above entitled matter and ordered that new counsel be appointed. (Docket No. 32). Mr. Dennis M. Charney has been appointed as counsel and has filed a motion to continue the matter. The motion asserts a continuance is necessary in order for counsel to review the discovery material and consult with the Defendant.

Based on the foregoing and in order to allow all defense counsel time to adequately prepare, the Court finds that the ends of justice served by granting a continuance outweigh the best interests of the public and the defendant in a speedy trial. 18 U.S.C. § 3161(h)(8)(A), (h)(8)(B)(iv). Thus, the Court HEREBY GRANTS Defendant's motion (Docket No. 34). The trial is rescheduled for Tuesday, September 10, 2002 at 9:30 a.m. in Boise, Idaho.

Any and all period of delay resulting from the granting of this continuance, from the date of the filing of the defendant's motion until the date of the rescheduled trial, shall be excludable time pursuant to 18 U.S.C. § § 3161(h)(1)(F) and (h)(8)(A), considering the factors under 18 U.S.C. § 3161(h)(8)(B)(iv).

IT SO ORDERED.
