ORDER PRETRIAL PSYCHIATRIC AND/OR PSYCHOLOGICAL EXAMINATIONS, PURSUANT TO 18 U.S.C. § 4242(a) [TO DETERMINE DEFENDANT'S SANITY].
Based upon motions by the United States in open court on February 23, 2005, to have pretrial psychiatric and/or psychological examinations performed to determine the defendant's sanity at the time of the offense; this Court ORDERS that pretrial psychiatric and/or psychological examinations, as provided for in 18 U.S.C. § 4242(a), be conducted to determine the defendant's sanity at the time of the offense.
Specifically, the Court ORDERS that, pursuant to 18 U.S.C. § 4247(b) and (c), the defendant be examined by Dr. Stephen L. Golding, a licensed and certified psychologist, at the local federally designated detention facility, to wit: Weber County, Utah, Jail.
The Court ORDERS that, pursuant to 18 U.S.C. § 4247(c), the resulting psychiatric and/or psychological reports be filed with the Court with copies issued to counsel for the United States and the defendant no later than Monday, April 11, 2005.
The Court ORDERS the United States Attorney to pay for these pretrial psychiatric and/or psychological examinations.
Finally, the Court ORDERS that Speedy Trial time be tolled from the date of this order until a hearing can be held to determine defendant's sanity upon his return from his psychiatric and/or psychological examinations, pursuant to 18 U.S.C. §§ 3161(h)(1)(a) and 4247(b).
