ORDER


On January 7, 2009, the Court dismissed criminal charges against the Defendant and ordered that he be evaluated pursuant to 18 U.S.C. § 4246 to determine whether his release would create a risk requiring that he continue to be committed to custody. The Court and counsel have now received a report from Kelley Adams, M.D., and Jill R. Grant, Psy. D., concluding that Defendant is not suffering from a mental disease or defect as a result of which his release would create a substantial risk of bodily injury to another person or serious damage to the property of another.

It is hereby ORDERED that counsel for both parties advise the Court not later than June 18, 2009, whether they object to the admission of this report in evidence, the closing of the record upon its admission, and the Court's concluding that Mr. Beeson should be released.

The United States Marshal is ORDERED to return Defendant to this jurisdiction and keep him in custody within the District pending further order of this Court.
