U.S. v. Abrams

United States District Court, S.D. Ohio, Eastern Division
Jun 24, 2009
Criminal Action 2:07-CR-62(2) (S.D. Ohio Jun. 24, 2009)

Opinion

Criminal Action 2:07-CR-62(2).

June 24, 2009

ORDER

Defendant Denise Abrams was convicted on her plea of guilty to one count of conspiracy to possess heroin in violation of 21 U.S.C. § 846 and was sentenced to six (6) weeks incarceration to be followed by one (1) year of supervised release. Judgment, Doc. No. 57. Defendant thereafter stipulated to new criminal convictions in violation of conditions of supervised release. See Minutes, Doc. No. 61. A final revocation hearing was held on June 24, 2009. Defendant was present with counsel.

It is evident that defendant's residential and employment instability persists. Moreover, defendant's former structured substance abuse treatment program is no longer available to her.

Under these circumstances, the Court concludes that the recommendation of the United States Probation Office, i.e., that defendant serve the remainder of her supervised release in a halfway house, is appropriate.

It is therefore ORDERED that defendant Denise Abrams reside at a halfway house, or community treatment center, for the remaining term of supervised release. It is further ORDERED that defendant Denise Abrams participate in a substance abuse treatment program under the direction of the United States Probation Office or officer.

Defendant shall report to the halfway house, as directed by the United States Probation Officer, no later than the close of business, June 26, 2009.
