[PROPOSED] SUMMARY JUDGMENT ORDER


The Court has considered the Plaintiff's Motion for Summary Judgment and all supporting declarations and documents as well as the verified Complaint for Forfeiture and pleadings herein. The Court also [has considered the opposition papers filed on behalf of the Claimant, Robert Slayton] [notes that the Motion is unopposed].

Based thereon, the Court finds that the Motion for Summary Judgment is well taken and should be granted.

THEREFORE, IT IS HEREBY ORDERED THAT:

Plaintiff's Motion for Summary Judgment is granted. Pursuant to Rule 56(a) of the Federal Ruled of Civil Procedure and 21 U.S.C. § 881(a)(6) the defendant $24,050 in United States Currency is hereby forfeited to the United States of America.

All right, title and interest in said $24,050 is hereby vested in the United States and all other claims to same, including any and all claims by Robert Lee Slayton, are hereby barred forever.

The United States Marshal shall dispose of the forfeited funds according to law.
