Oct 22, 1987
514 So. 2d 4 (Fla. Dist. Ct. App. 1987)

Opinion

No. 86-2258.

October 22, 1987.

Appeal from the Circuit Court for Marion County; Carven D. Angel, Judge.

Richard W. Prospect of Haas, Boehm, Brown, Rigdon, Seacrest Fischer, P.A., Daytona Beach, for appellant.

Ralph J. McMurphy of Green and Simmons, P.A., Ocala, for appellee.

Based on our opinion in United States Fidelity Guaranty Company v. American Fire and Indemnity Company, 511 So.2d 624 (Fla. 5th DCA 1987), we reverse the trial court's award of attorney's fees to the appellee. Because of this determination, we deny appellee's motion for attorney's fees in connection with this appeal.

REVERSED.

COBB, SHARP and COWART, JJ., concur.
