ORDER REGARDING PUBLICATION OF ORDER
This matter is before me on the government's request, by letter dated October 22, 2001, that I publish my September 27, 2001 order accepting the recommendation of Magistrate Judge Coan. In light of the paucity of published authority on the issue of the standard of review applicable to the government's motion to dismiss a qui tam action under the False Claims Act, 31 U.S.C. § 3730(c)(2)(A), I will concur with that request and include the underlying recommendation of Magistrate Judge Patricia A. Coan.
Accordingly, my September 27, 2001 order and Magistrate Judge Coan's August 7, 2001 recommendation shall be published.
