An appeal having been taken to this Court from an order of the Supreme Court, New York County, entered on or about May 13, 2021, and said appeal having been perfected, And defendant-appellant having moved for leave to serve and file a replacement brief which discusses the applicability of the recently enacted Foreclosure Abuse Prevention Act (FAPA), and related relief, Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon, It is ordered that the motion is denied, and the perfected appeal is adjourned to the May 2023 Term of this Court upon the briefs and record which have already been filed, unless defendant-appellant seeks to adjourn the appeal pending further motion practice in Supreme Court.
