UNITED STATES' MOTION TO DISMISS AND ORDER

The United States of America, by and through its undersigned counsel, hereby moves for dismissal of the above-captioned matter for the following reasons.

The Federal Bureau of Investigation advised the government this evening that the defendant was apprehended in Mexico and is currently in the United States. The United States moves to dismiss the UFAP complaint in this matter in order to allow the Tulare County District Attorney's Office to pursue pending homicide charges filed against the defendant.

ORDER

IT IS SO ORDERED.
