UNITED STATES OF AMERICA v. GERY SHALON, Defendant.
SEALED ORDER
LAURA TAYLOR SWAIN UNITED STATES DISTRICT JUDGE.
WHEREAS, an application has been made by the United States of America, with the consent of the defendant, for the sealing of the following:
(1) With regard to United States v. Shalon, 15 Cr. 333 (LTS): (a) the transcript of the defendant's guilty plea proceeding; (b) the Superseding Information to which the defendant pleaded guilty; (c) the defendant's plea agreement; (d) documents related to the defendant's bond or conditions of release; (e) all docket entries associated with the defendant's guilty plea, bond or conditions of release, including notifications of docket entries over the ECF system; and (f) any further docket entries in 15 Cr. 333 regarding defendant Shalon, including notifications of docket entries over the ECF system; and
(2) With regard to United States v. Shalon, 17 Cr. 254 (LTS): the entirety of the docket and all entries therein; and
WHEREAS, the Court finds that the safety of the defendant and others may be placed at risk and active law enforcement investigations may be compromised if the Government's application is not granted;
IT IS HEREBY ORDERED that, with regard to 15 Cr. 333, the transcript of the defendant's guilty plea proceeding; the Superseding Information to which the defendant pleaded guilty; the plea agreement between the defendant and the Government; all documents related to the defendant's bond or conditions of release; all docket entries associated with the defendant's guilty plea, bond, or conditions of release; this Order; and the Government's application for this Order, shall be sealed and, if applicable, retracted and withdrawn from the ECF system; and
IT IS FURTHER ORDERED that, with regard to 15 Cr. 333, no docket entries shall be made with respect to this defendant in the above-captioned matter until further order by this Court; and
IT IS FURTHER ORDERED that, with regard to 17 Cr. 254, the docket and all entries thereto be placed under seal, including but not limited to this Order and the Government's application for this Order; and
IT IS FURTHER ORDERED that counsel for the defendant Shalon and the Government may be provided a copy of the transcript of the proceedings regarding Shalon in either case without further Order of the Court; and
IT IS FINALLY ORDERED that the Government shall report to the Court on or before six months after execution of this Order regarding the continuing need, if any, to maintain these matters under seal.
