DECISION AND ENTRY FINDING DEFENDANT IN VIOLATION OF
SUPERVISED RELEASE, REVOKING SAME AND IMPOSING SENTENCE,
WITH A PERIOD OF SUPERVISED RELEASE TO FOLLOW, UPON
CERTAIN STATED CONDITIONS; RIGHT OF APPEAL EXPLAINED AND
UNDERSTOOD; TERMINATION ENTRY ON SUPERVISED RELEASE
VIOLATION
On November 19, 2013, the Defendant, having previously been found in violation of his reimposed period of supervised release which began May 30, 2013, appeared in open Court for final disposition.
Pursuant to the record made on the aforesaid November 19, 2013, the Defendant's supervised release was revoked and he was remanded to the custody of the Attorney General of the United States, the Bureau of Prisons, for a period of eight months, with credit given for all available pre-revocation jail time credit from October 30, 2013. The eight month sentence is to be followed by a 36-month period of supervised release, less the 70 days previously served on prior violations. As conditions of the further re-imposed period of supervised release, the Defendant is to follow all the rules and regulations of the Probation Department, fulfill all conditions of supervised release, presently undischarged, that were previously imposed upon him when he was initially placed on supervised release and, finally, that he spend up to the first six months of his period of re-imposed supervised release in a halfway house facility with work release privileges.
Following the above, the Court orally explained to the Defendant his right of appeal and he orally indicated his understanding of same.
The captioned cause is ordered terminated, insofar as the supervised release matter is concerned upon the docket records of the United States District Court for the Southern District of Ohio, Western Division at Dayton.
