FINAL REVOCATION OF SUPERVISED RELEASE AND JUDGMENT

On May 25, 2022, this matter came before the Court on Petition on Probation and Supervised Release originally filed on February 23, 2022. Government counsel, Kim Meyer, the defendant and his appointed Deputy Federal Public Defender attorney, Adam Olin and Michael Citrin, were present. The U.S. Probation Officer, Cynthia Carr, was also present.
The defendant admitted the allegations, in violation of his supervised release, as stated in the Petition filed on February 23, 2022. The Court finds that the defendant is in violation of the terms and conditions of his supervised release imposed on August 9, 2010.
IT IS ORDERED AND ADJUDGED, upon the findings of the Court, the defendant's supervised release is hereby revoked. Defendant is hereby committed to the custody of the Bureau of Prisons for a term of time served. Defendant shall be released from custody directly into an outpatient treatment facility, pending placement of the residential treatment program. Defendant's placement in a Treatment Facility shall take place on or before June 30, 2022.
Upon release from imprisonment, defendant shall be placed on supervised release for a period of one (1) year, under the same terms and conditions previously imposed, with the following added special conditions:
• Defendant shall comply with the rules and regulations of the United States Probation and Pretrial Services Office and Second Amended General Order 20-04;
• The defendant shall reside at, participate in and successfully complete a residential substance abuse treatment and counseling program approved by the United States Probation and Pretrial Services Office, that includes testing to determine whether the defendant has reverted to the use of drugs or alcohol; and defendant shall observe the rules of that facility;
• As directed by the Probation Office, the defendant shall pay all or part of the costs of the Court-ordered treatment to the aftercare contractors during the period of the community supervision. The defendant shall provide payment and proof of payment as directed by the Probation Officer. If defendant has no ability to pay, no payment shall be required; and
• Defendant shall submit to a mental health evaluation. If directed to do so, participate in mental health counseling and/or treatment approved by the United States Probation and Pretrial Services Office, until discharged from the program by the treatment provider, with the approval of the Probation Officer. The defendant shall provide payment and proof of payment as directed by the Probation Officer. If the defendant has no ability to pay, no payment shall be required.
IT IS FURTHER ORDERED that the Clerk deliver a copy of this judgment to the United States Marshal or other qualified officer and that said copy shall serve as the commitment of defendant.
