ORDER


Presently before this court is the motion of the United States to enter the Consent Decree between the United States and Mack Trucks, Inc. ("Mack Trucks") that was filed with this court on October 22, 1998. The Consent Decree resolves the claims of the United States against Mack Trucks for alleged violations of the Clean Air Act, as amended, 42 U.S.C. § 7401, et seq.

Upon consideration of the United States' motion and a thorough review of the submissions that accompany the motion, including the comments from the public relating to the Consent Decree and the Consent Decrees in related cases and the United States' responses thereto, the court concludes that the Consent Decree is fair, reasonable and consistent with public policy. Consequently, the Consent Decree will be approved.

Accordingly, it is this 1st day of July 1999, hereby

ORDERED that the Consent Decree between the United States and Mack Trucks is hereby APPROVED AND ENTERED.
