DECISION AND ENTRY OVERRULING MOTION FOR RELIEF FROM
DETENTION ORDER (DOC. #29); ALTERNATE SOLUTION SUGGESTED
Pursuant to a thorough review of the Pretrial Services's Report submitted to the Magistrate Judge on June 16, 2014, this Court finds not well taken and does, therefore, decline to review the Defendant's bond and grant relief from the detention order previously imposed (Doc. #29). In short, given the extreme seriousness of the charges pending against the Defendant, charges upon which a duly impaneled Grand Jury found probable cause to believe, not to mention his fourteen prior warrants for failure to appear to answer various charges and/or to honor payment agreements previously made and, further, the fact that Defendant is presently on active parole, this Court concludes, by clear and convincing evidence, that there exists no condition or combination of conditions that will reasonably assure the appearance of the Defendant as required and the safety of the community.
As an alternative, should Defendant's counsel submit to this Court, not later than August 1, 2014, documentation attesting to the Defendant's medical condition and its severity, as well as confirming his upcoming two medical appointments, the Court will grant the Defendant a brief absence from the Montgomery County Jail, in the custody of the United States Marshals Service, to attend these appointments.
