OPINION AND ORDER

A plea agreement has been filed in the above case. However, the change of plea proceedings before the magistrate judge were adjourned when the defendant disagreed with several allegations in the government's proposed statement of facts. The government indicates that the negotiations of the parties are now at an impasse. The government has moved this court to schedule the case for trial. Due to other trial commitments in October, counsel for the government has requested a trial date after November 1, 2013.

The court finds pursuant to 18 U.S.C. §3161(h)(7) that a trial date after November 1, 2013, is warranted in the interests of justice and that the need for a continuance outweighs the best interests of the defendant and the public in a speedy trial. Defendant is charged with eleven substantive counts and forfeiture allegations. Because the work of counsel to this point has been focused on plea negotiations, counsel for both parties will require additional time to prepare for trial despite the exercise of due diligence. A continuance is also needed to ensure continuity of counsel for the government. 18 U.S.C. §3161(h)(7)(B)(iv). The motion (Doc. 22) is granted. The trial is continued to November 4, 2013, at 9:00 a.m.
