DECISION AND ENTRY FINDING DEFENDANT IN VIOLATION OF
SUPERVISED RELEASE, REVOKING SAME AND IMPOSING SENTENCE,
WITH REIMPOSED PERIOD OF SUPERVISED RELEASE TO FOLLOW,
UPON CERTAIN STATED CONDITIONS; RIGHT OF APPEAL EXPLAINED
AND UNDERSTOOD; TERMINATION ENTRY
On March 13, 2014, the Defendant, having previously been found in violation of his supervised release which began April 4, 2013, appeared in open Court for final disposition.
Pursuant to the record made on the aforesaid March 13, 2014, the Defendant's supervised release was revoked, and he was remanded to the custody of the Attorney General of the United States, the Bureau of Prisons, for a period of twelve months, with credit given for all allowable presentence jail time, to wit: from October 16, 2013, through February 25, 2014, while the Defendant was in state custody for an offense which formed the basis of the above-referenced revocation, and from February 26, 2014, the day he was turned over to federal custody from the state authorities, through the date of revocation and sentencing on March 13, 2014.
The twelve month sentence, with the above-referenced credit, is to be followed by a four year period of supervised release, upon the condition that he discharge all previously undischarged conditions of supervision, continue his efforts at schooling, secure and maintain employment, to be enrolled in a course of anger management and to stay out of nightclubs for the duration of his supervision.
Following the above, the Defendant was orally explained his right of appeal, and he indicated an understanding of same.
The captioned cause is ordered terminated upon the docket records of the United States District Court for the Southern District of Ohio, Western Division, at Dayton.
