Opinion

Case No. 3:09cr034 (2)

03-03-2014

UNITED STATES OF AMERICA, Plaintiff, v. CHARLES STANLEY ESSEX, Defendant.

JUDGE WALTER H. RICE

DECISION AND ENTRY DEFERRING DECISION ON WHETHER TO

REVOKE SUPERVISED RELEASE, PENDING A FURTHER COURT

APPEARANCE SCHEDULED FOR MAY 22, 2014, AT 2:00 P.M.

On January 21, 2014, the Defendant, having been previously found in violation of his supervised release which began July 22, 2010, appeared in open Court for final disposition.

Pursuant to the record made on the aforesaid January 21, 2014, the Court deferred a decision on whether to revoke supervision until May 22, 2014 at 2:00 p.m. During the interim, the Defendant is to report to Laura Sebulsky, United States Probation Officer, on Monday, January 27, 2014, and to report for testing every other week, on a Monday, after that date. Should the Defendant's levels of marijuana go down, showing the Court that he is weaning himself from marijuana, should he still be attending NA/AA, thus finding other ways to relieve stress, this Court will terminate his supervised release, some fourteen to fifteen months prior to its scheduled expiration date of July, 2015.
