FINDINGS AND RECOMMENDATION

HON. STACIE F. BECKERMAN, United States Magistrate Judge

TO THE HONORABLE ANNA J. BROWN, U.S. DISTRICT JUDGE:

Upon defendant Tashina Lutan Winyan Eastman's (“Eastman”) request to enter a plea of guilty to Count I of the Information, this matter came on for hearing before U.S. Magistrate Judge Stacie F. Beckerman on June 21, 2022, with the consent of Eastman, counsel for Eastman, and counsel for the United States of America.

The hearing on Eastman's plea of guilty was in full compliance with Federal Rule of Criminal Procedure 11, before the magistrate judge in open court, and on the record.

In consideration of that hearing and the statements Eastman made under oath on the record and in the presence of counsel, and the remarks of the Assistant United States Attorney and of counsel for Eastman,

THE COURT FINDS as follows:

(1) Eastman understands the nature of the charge against her to which she offered the plea;
(2) Eastman understands her right to trial by jury, to persist in her plea of not guilty, to the assistance of counsel at trial, to confront and cross examine adverse witnesses, and her right against compelled self-incrimination;
(3) Eastman understands the maximum possible sentence, including the effect of the supervised release term, and Eastman understands the application of the advisory sentencing guidelines;
(4) Eastman understands the term of her plea agreement waiving her right to appeal or collaterally to attack her sentence;
(5) Eastman's plea of guilty has been knowingly and voluntarily made and is not the result of force or threats;
(6) Eastman is competent to plead guilty;
(7) Eastman understands that her answers may later be used against her in a prosecution for perjury or false statement; and
(8) there is a factual basis for Eastman's plea.

Accordingly, I RECOMMEND that the district judge accept Eastman's plea of guilty to Count I of the Information.

Any objections to the Findings and Recommendation are due within fourteen (14) days. If no objections are filed, the Findings and Recommendation will go under advisement on that date. If objections are filed, any response is due within fourteen (14) days. When the response is due or filed, whichever date is earlier, the Findings and Recommendation will go under advisement.
