DECISION AND ENTRY OVERRULING DEFENDANT'S MOTION TO REDUCE RESTITUTION AMOUNT (DOC. #61); OFFER MADE TO DEFENDANT'S COUNSEL
Pursuant to the reasoning, references to the record and citations of authority set forth by the Government, in its Memorandum (Doc. #62) filed in opposition to the Defendant's Motion to Reduce Restitution Amount (Doc. #61), said Motion is deemed by this Court to be not well taken and same is, therefore, overruled. Given that Defendant has failed to file a reply memorandum, contesting anything set forth by the Government in its Memorandum Contra (Doc. #61), this Court concludes, as represented by the Government, that "[w]hatever civil damage amounts may have been recovered against the Defendant in said unspecified civil action, has absolutely no relationship with any of the identified victims in the captioned causes."
WHEREFORE, based upon the aforesaid, this Court finds not well taken and does, therefore, overrule Defendant's Motion to Reduce Restitution Amount (Doc. #61). Should Defendant's counsel have information in his hand that would rebut the Government's Memorandum Contra, same must be submitted to this Court not more than ten calendar days from date.
