Case No. 3:98cr011 (13)

05-08-2014

UNITED STATES OF AMERICA, Plaintiff, v. KALON CHANCE, Defendant.

JUDGE WALTER H. RICE

DECISION AND ENTRY OVERRULING DEFENDANT'S MOTION TO SEAL RECORD (DOC. #315) AND TO SEAL CASE (DOC. #316) FOR LACK OF SUBJECT MATTER JURISDICTION

The Defendant has filed both a Motion to Seal his criminal record (Doc. #315) and a Motion to Seal the captioned cause (Doc. #316).

Unfortunately, the federal criminal justice system does not provide for an expungement/sealing of a Defendant's criminal conviction and the file on which the conviction was based. State v. Lucido, 612 F.3d 871 (6th Cir. 2010); United States v. Bass, No. 2:89-cr-138-1, 2012 WL 871215 (S.D., Ohio, March 13, 2012). Accordingly, the motions of the Defendant are overruled for lack of this Court's subject matter jurisdiction to grant same.
