REPORT & RECOMMENDATION
Presently before the court is Defendant Edwin Arnold's Motion to Suppress (ECF No. 38), filed on May 8, 2017. The government filed a response (ECF No. 42) on May 22, 2017. Defendant filed a reply (ECF No. 45) on May 30, 2017.
Defendant moves to suppress statements he made to law enforcement officers on January 26, 2017, arguing that he did not receive a constitutionally-adequate Miranda warning in violation of his Fifth and Sixth Amendment rights. The government responds that the motion should be denied as moot because it does not intend to introduce in its case-in-chief at trial the statements at issue or any evidence derived from those statements. Defendant replies that notwithstanding the government's representation that it will not use the statements at issue, Defendant seeks an order finding that the interrogation violated his constitutional rights.
Having reviewed and considered the parties' arguments, the court finds that the motion is moot given the government's representation that it will not introduce the statements at issue in its case-in-chief at trial. If the government attempts to introduce the statements at trial, Defendant may move to exclude the statements at that time.
IT IS THEREFORE RECOMMENDED that Defendant Edwin Arnold's Motion to Suppress (ECF No. 38) be DENIED as moot.
